Facing criminal charges are scary and potentially life altering. Our Bellingham criminal defense attorneys understand this and are there to protect you if the need arises. Appearing in a Whatcom County Court alone is never advised as a serious criminal offense such as DUI, Reckless Driving, Assault, Theft and other serious driving crimes may result in harsh and immediate penalties. Your freedom, your driving privileges, your finances and reputation may all be on the line. A conviction of a crime may also place serious limits to your life, your family and your ability to travel. Our Law Firm is here to remind you that being charged with a crime does not equal a conviction. You are presumed innocent and it is this presumption that we believe is critical at the beginning and through a criminal case. There is always hope and this must be maintained. However, to maintain your freedom and to fight and protect yourself you must secure the right legal services. When you hire a Bellingham criminal defense lawyer, you must be confident that you are being represented by a law firm that will do anything it takes within the legal system to achieve a favorable outcome. Our Whatcom County criminal attorneys have the hands-on experience needed to fight for our clients in court.
As an experienced criminal defense law firm we understand that a quality defense case takes hard work, time, knowledge and a personal commitment to excellence. We will fight tirelessly for you and use every resource we have to obtain the best results, not the easiest results. Our criminal defense attorneys are former prosecutors and public defenders and we have done the hard yards so that we are equipped to help our clients. We have collectively tried more than 100 trials and over 1,000 Department of Licensing Hearings. We understand what it takes to beat the system and what must be done to generate reasonable offers or win at trial. We care about your results and because of this we have earned our reputation as successful, knowledgeable and no-nonsense Bellingham criminal attorneys. This reputation is a great advantage to our clients as the prosecutors we face understand that our criminal attorneys have the knowledge, aggression and perseverance to win cases. As a result we receive reasonable offers that other Whatcom County criminal defense attorneys may not. With criminal charges it is imperative to act quickly and the earlier we get involved in your defense, the better.
David Jolly has been practicing DUI law in Washington for more than 20 years and the law firm has significantly more than 60 years of combined DUI experience. He is a graduate of Northern Illinois University College of Law and was the graduating Valedictorian. While in law school he represented the school in national moot court competitions and founded the law school's largest student organization. His professional career started as a prosecuting attorney in Snohomish County. He never lost a DUI trial as a prosecutor. After his nearly four years as a prosecuting attorney he left the prosecutor's office and began representing private clients. He now calls Bellingham, Washington home and his main law office is located in downtown Bellingham, directly across the street from the Whatcom County District Court and only 2 blocks from Bellingham Municipal Court.
I cannot recommend David and his staff enough. He has represented me on a DUI and a speeding ticket. I felt ashamed when I was arrested for DUI but David and Janean never judged me and from the very first meeting, were caring and thoughtful. The results were excellent too, as the DUI was reduced to a far less serious offense with no jail and no license suspension. If you want to be taken care of look no further. If you want a lawyer who is knowledgeable and honest, look no further. If you simply want a sleazy sales pitch, look elsewhere.

probation
Probation is a necessary evil following the disposition of a criminal case and in some instances, following a criminal charge at arraignment. Knowing location courts and their individual requirements can save jail and unnecessary expenses.
A DUI (driving under the influence) arrest may be the single most stressful event you have ever experienced. The criminal court system is frightening and intimidating environment for just about anyone - especially for those who have never been in trouble with the law before. In an instance, a person's future can change. If your arrest occured in the Bellingham area, the best thing you can do protect your future would be to hire a DUI lawyer. Whatcom County attorney David Jolly is that lawyer to call!
At the Law Firm of David N. Jolly, we are committed to achieving the best outcome possible for each one of our clients. We represent clients from as for north as Whatcom County all the way south to Snohomish County. DUI defense attorney David Jolly is ready to talk to you if you have been arrested or are under investigation for any type of DUI arrest, whether it be a DUI involving alcohol or a DUI involving drugs.
By consulting with and eventually retaining a DUI lawyer Whatcom County, Snohomish County or Skagit County prosecutors are immediately put on notice that your case will involve much more work on their behalf. Their case will now be scrutinized and investigated and not assumed to be straight forward and an easy conviction. The more you make a prosecutor work, but better the chance that you’ll receive a more favorable outcome. We can meticulously examine every part of your arrest, from the initial police stop to the field sobriety tests to the DOL hearing and the final trial. After our investigation, an aggressive defense strategy will be mounted and taken to court if your charges have not been reduced or dropped before then.
The extent of the penalties for drunk driving in Washington depend on whether you were charged with DUI with a BAC above 0.15 (or a “refusal”) or less than 0.15. Regardless of the apparent severity of your Whatcom County DUI charge, you could be required to pay steep fines and court costs, receive a license suspension, complete an alcohol drug evaluation, enroll in an alcohol education program, attend a DUI victim panel, install an ignition interlock device for a minimum period of one year, obtain SR 22 insurance and serve a jail sentence. You will also be placed on probation for as much as five (5) years. However, these penalties are only if you are convicted or driving under the influence and it is our objective to ensure this does not happen. It is important to remember you have options when facing a serious charge such as driving under the influence. Please call our office to talk about your case and the viable options you have when facing a DUI.
If you were convicted of a DUI or were placed on Deferred Prosecution, the length of probation is five years! At any point in time during probation, if the court believes you failed to comply with any part of your probation such as a new criminal charge or failure to pay fines or complete treatment, you will likely be summoned to the court for what is known as a probation review hearing. You must take probation reviews very seriously.
If you have received a summons for a probation review it is highly advisable that you immediately secure the necessary level of legal representation to help you navigate through this intimidating time. During a probation review, it is likely that they will either be ensuring that you have not violated any terms or conditions imposed by the sentencing Judge or, admitting that you have. Either way, your future will hang in the balance and your freedom placed in jeopardy. For this reason, if you are facing a probation review hearing, you should not hesitate to contact criminal defense attorney David Jolly as soon as possible. If you have been convicted of a crime it is probable that you will be placed on probation. The primary goal at that point is to ensure probation goes smoothly and that there is no need for any probation reviews. However, if you do violate probation you absolutely need a probation review attorney to help you avoid jail.
